Terms and Conditions of Use

These terms and conditions establish the rules for using the application related to Digital Visual Seals (hereinafter referred to as SVD), issued by INCM, for the certificate of attendance of the UNICON Team Development Conference 2024.

By installing and/or using the application on a mobile device, users are deemed to have read, accepted and agreed to comply, without reservation, with these Terms and Conditions in their entirety, as well as the privacy policy.

A: DEFINITIONS

User - means any person, whether an adult or minor, who installs the application on their mobile device.
Application - software that can be accessed on the Google Play Store, Huawei AppGallery and App Store (Apple) platforms for installation on compatible mobile devices
QR Code - 2D barcode that stores information in a series of pixels in a square pattern.
Digital Visual Seal (SVD) – consists of a 2D barcode (QR Code or Data matrix), containing signed information necessary to validate the authenticity of the document.
Personal data – information relating to an identified or identifiable natural person ("data subject"), in accordance with number 1 of Article 4 of the GDPR, an identifiable natural person is considered to be a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, electronic identifiers or one or more elements specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

B: PURPOSE OF THE APPLICATION

The application aims to prevent document fraud by checking the authenticity of the SVD in real time.

The application allows users to read the digital seal contained in the certificate of attendance to the UNICON Team Development Conference 2024 in the form of a QR-code. Allows to prove the authenticity and integrity of the information presented on the certificate.

C: REQUIREMENTS TO USE THE APPLICATION

The mobile device must meet the following requirements to use the application:

• Android Operating System with version 10 or higher or iOS with version 14 or higher;

• Internet access.

D: APP AVAILABILITY

INCM guarantees security in accessing, viewing and using the content and services made available through the application.

The expected availability will be 24 hours a day, 7 days a week, except for reasons of force majeure or the occurrence of an event beyond the control of INCM, and during operations of:

• technical maintenance

• updates

• technical improvements or content changes

• for security reasons

• for any other reason deemed necessary

Such operations may be carried out at any time, without prior notice to the user.

The user will not be entitled to any compensation if the application is not available or does not work correctly.

E: FINANCIAL CONDITIONS

There are no costs for purchasing the application. However, for its correct use, internet access is required, which may incur costs for the user, which are their sole responsibility.

F: APPLICATION INTELLECTUAL PROPERTY

INCM is the exclusive owner of all intellectual property rights relating to the structure and content of the application, unless expressly stated otherwise and unless otherwise stipulated by law or contract.
None of the elements that make up the application may be represented, reproduced, explored or extracted, partially or totally, in any medium, without express written authorization from INCM.

G: USE LICENSE

INCM grants users a free license to use the application, strictly limited to the purpose identified in article 2.
Users may not use the application for commercial purposes, including any commercial profit or revenue resulting from the marketing of the application or any competitive use.
The license is non-exclusive, non-transferable and may be revoked at any time.
 
 
 
 
 
 
 

H: LIMITATION OF RESPONSIBILITY

INCM is not responsible for:
· Information contained in the certificate.
· Interruption of access to the application and/or its services due to operations referred to in point D, or internet connection failures.
· Technical performance of the Internet and mobile device that may be limiting in processing to respond, view, request or transfer information.
· Temporary or permanent suspension of the use of the application, which will not give the right to any compensation.
It is the user's responsibility:
· Keep the application version on your device up to date.
· Damages of any kind, direct or indirect, resulting from the use or inability to use the application or associated services, especially any operational, financial or commercial loss, or loss of programs and/or data in the information system. 
· Damage caused to the user, the terminal, the computer or telephone equipment and the data stored there, or the consequences of such damage for their personal, professional or commercial activities.
· Any improper use of mobile equipment, or any incident related to the use of that device while running the application. 
· Use of the application is at your own risk. 
·  Protect your own data stored on your device and/or in software, and by taking all appropriate measures to protect it from damage (loss, malfunction, viruses, hacking, etc.).
· Do not use the application for fraudulent or profit-making purposes.
·  Any breach of your obligations under these Terms and Conditions and the consequences of such breach.
 

I: PRIVACY AND DATA PROTECTION POLICY

INCM does not store or transfer any personal data when using the application.
 
Personal data collected by the stores that make the application available for installation: Google Play Store, Huawei AppGallery and App Store (Apple), are processed by the responsible entities themselves. INCM is not responsible for processing this data.

J: CHANGES TO THE GENERAL TERMS AND CONDITIONS OF USE

INCM reserves the right to modify, expand or supplement any or all these terms and conditions at any time, if there are changes to the services, technical, jurisprudence or legal changes, or any new services that may be introduced.

Only the most recent version of the terms and conditions accessible online is in force at the time of using the application.

L: APPLICABLE LAW AND ATTRIBUTION OF JURISDICTION

These terms and conditions are subject to Portuguese legislation.

Any dispute or disagreement arising from its application or interpretation, and which has not been resolved amicably, will be subject to the jurisdiction of the Portuguese courts.
